NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. THIS COMPETITION IS OPEN TO LEGAL RESIDENTS OF FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA AND ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE RULES BELOW). VOID WHERE PROHIBITED.
**Name: **Rusty Taco Franchising LLC ® Basketball Bracket Competition (the “Competition”).
**Timing: **The Competition entry period is scheduled to begin at 12:00 a.m. Eastern Time (ET) on 3/18/2025 and end at 11:59:59 PM Eastern Time (ET) on 4/8/2025 (the “Entry Period”). Administrator’s computer is the official time-keeping device for this Competition.
Who May Enter: Competition is open to legal residents of the fifty (50) United States and District of Columbia who are age 18 or older as of the date of entry and who have a valid U.S. driver’s license or government-issued photo identification, excluding the following classes of persons who are not eligible to enter or receive a prize: employees, officers, and directors of Rusty Taco LLC (“Sponsor”), their respective franchisees, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this Competition (collectively “Released Parties”), as well as the immediate family members or households of any of the above, whether or not related. “Immediate family members” include, for purposes of this Competition, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grandchildren (including step-grandchildren), and each of their respective spouses. Limit one (1) entry per person/email address during the Entry Period, regardless of entry method. All entries must be received by the beginning of the Entry Period to be eligible. Any entries received after the Entry Period will be disqualified. Automated or robotic entries submitted by individuals or organizations will be disqualified.
Online Entry: During the Entry Period, visit www.play.ncaa.com/mens-bracket-challenge (the “Website”) and join the official Rusty Taco Group. By joining the Rusty Taco Group, Entrant agrees that Sponsor is authorized to contact Entrant via email, mail, phone, or any other form of media to make Entrant aware of information pertinent to the Competition. Entrants may opt out of any further email communication at any time by clicking on unsubscribe located in the footer of promotional emails from Sponsor. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the email address used to register will be deemed to be the registrant and must be eligible according to these Official Rules. All entries received become the property of the Sponsor and will not be returned. This Competition is in no way sponsored, endorsed, administered by, or associated with the National Collegiate Athletic Association (NCAA) or any of its member institutions. All Federal, State and local laws apply.
Winner Selection, Notification, and Verification: On or about 4/19/2025, the Administrator will announce the winning entry (user) based on the highest-scoring bracket according to NCAA’s official scoring system. If there is a tie, the winner will be determined based on the closest guess of the total points scored in the championship game. If a tie remains, a random drawing among tied participants will be conducted to determine the winner. The winner will be contacted via the email provided at the time of entry. If the Administrator is unsuccessful in its attempt to reach and speak directly with a potential winner by phone and/or email within 48 hours of the initial notification attempt, that entrant may be disqualified, and an alternate potential winner may be selected. Phone messages will not be left during the winner notification process. Potential winner(s) may be required to execute and return an Affidavit of Eligibility, a Liability Release, and where legally permissible, a Publicity Release within five (5) days of the date notice is sent. If a potential winner fails to return these documents within the specified time, or if any notification is returned as undeliverable, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, the prize may be forfeited and an alternate winner may be selected. Sponsor shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information.
Grand Prize: One (1) Grand Prize will be awarded in this Competition. The Grand Prize Winner will receive Free Queso for a Year at Rusty Taco, approximately valued at $167.40, awarded in the form of a Rusty Taco reward card accepted at participating Rusty Taco restaurants. The reward codes entitles the winner to one free side of queso and chips three times per calendar month, for 12 consecutive months. Unused sides will expire at the end of each calendar month. Redemptions can be made any time during the month but are limited to business hours and may exclude certain major holidays. The reward codes are subject to these Official Rules and may not be replaced if lost or stolen. No rainchecks, refunds, or substitutions will be provided. The approximate retail value (“ARV”) is $167.40. Rewards can only be redeemed at the Rusty Taco location decided upon by the winner. Prizes are non- transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded as described for any reason, Sponsor reserves the right to substitute the prize with another prize of equal or greater value. Winner is responsible for all applicable federal, state, and local taxes and all other costs and expenses associated with prize acceptance and use not specified herein as being provided. Gift cards are subject to the terms and conditions of the issuer. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded.
Additional Rules & Restrictions: Competition is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. By participating, entrants agree to abide by these Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Competition. If a winner is found to be in violation of these Official Rules, the prize must be forfeited, or reimbursement must be made to the Sponsor. Participation in the Competition constitutes permission for the Sponsor to use entrants’ names, cities, states of residence, and likenesses for advertising and promotional purposes without further compensation, unless prohibited by law. Sponsor reserves the right to cancel, suspend, and/or modify the Competition, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Competition, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize(s) at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
**Odds: **The odds of winning depend on the total number of valid bracket entries and performance in the 2025 NCAA Men’s Basketball Bracket Challenge.
Privacy: Sponsor is committed to protecting privacy. To enter the Competition, entrants must join the Rusty Taco Group at www.play.ncaa.com/mens-bracket-challenge. Any personal information collected will be used in accordance with Sponsor’s privacy policy and will not be sold or shared.
Release and Limitations of Liability: By participating in the Competition, entrants agree to release and hold harmless Rusty Taco Franchising LLC, its parent company, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any and all liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Competition and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, or software, (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service, (iv) unauthorized human intervention in any part of the entry process or the Competition, (v) electronic or human error in the administration of the Competition or the processing of entries.
In Case of Disputes: By participating, each entrant agrees that any disputes related to the Competition shall be resolved individually, without class action, and exclusively in a federal or state court in Texas. Any claims are limited to actual out-of-pocket expenses incurred in entering the Competition, and entrants waive rights to claim punitive, incidental, or consequential damages. The Competition shall be governed by Texas law without regard to conflict of law principles. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Competition), and participant further waives all rights to have damages multiplied or increased.
**Winner List: **To obtain a copy of these Official Rules or a list of the prize winners, send a self- addressed, stamped envelope to Rusty Taco LLC, 5412 W Plano Pkwy #100, Plano, TX 75093, specifying whether you are requesting official rules or a list of winners. Requests must be received by 5/10/2025.
